MINUTES OF THE PUBLIC HEARING/MEETING OF THE TOWN OF ST. FRANCISVILLE MAYOR AND BOARD OF ALDERMEN, ST. FRANCISVILLE, LA, TUESDAY, FEBRUARY 26, 2013, 5:30 P. M.

The Town of St. Francisville Board of Aldermen met in regular session this 26thday of February, 2013 at 11936 Ferdinand St., Town Hall, St. Francisville, LA.  The meeting was called to order at 5:30 p. m. with the following members present:  Mayor William D’Aquilla, James R. Leake, Oscar Robertson, Jr., Abby T. Cochran, James Davis, and Robert P. Leake
 
Absent: Town Attorney Jesse L. Means.
 
The Pledge was led by Lane and Ethan White, sons of Erin Foster.                     .
On motion by Abby T. Cochran, and seconded by Oscar Robertson Jr., the minutes of January 22, 2013 were approved as circulated.  All in favor, motion carried.
 
Motion made by James Davis, Seconded by James R. Leake, to approve $4800.00 to publish the Comprehensive Zoning Ordinance in the paper. Motion carried.
 
Matte’s Plumbing will be hired on an as needed basis to inspect the Backflow Preventers previously installed by Town customers. The $100 fee will be paid for by each customer inspected.
 
Trash in yards has become a problem that is being handled through Mayor’s Court. If junk and trash remain in the yards, pictures will be posted in the newspaper as an additional deterrent.
 
A motion by Oscar Robertson Jr. and seconded by James Davis to accept the Access Agreement between the Town and Joseph Gallego was approved.
 
 
PEC Update –
Burnett Road Bridge: Jim Fergusen evaluated the bridge. His report will be available for the March 12, 2013 meeting. A possible emergency Capital Outlay request from the State during the current Legislative session, may be available to help with the cost. Representative Kenny Havard and Consultant James Purpera are working on this for the Town. 
Final pay request for Retainage and Final Change Order for Contract 2 of sewer project was approved.
Gas System Rehab in Hardwood- waiting to finalize Cooperative Endeavor Agreement with Facility Planning. James Purpera is helping with request to waive the Town’s match portion.
 
RESOLUTION 2013-3
WHEREAS, The Town of St. Francisville Council agrees to accept ownership of whatever rights the State of Louisiana, Department of Transportation and Development (the “Department”), may own in and to the following described property and agrees to accept all duties, obligations, and responsibilities for the operation, maintenance, and liabilities associated therewith, for its use as a city street, subject to the conditions stated herein:
The portion of state route LA 1263 known as Ferdinand Street from its intersection with LA 3051 known as Commerce Street, proceeding southwesterly approximately 1.21 miles to the end of the control.
The portion of concurrent state route LA 1263 and LA 3057 known as Commerce Street and LA 1263 known as Ferdinand Street northwest approximately 0.44 miles to the north intersection of LA 3057 known as Commerce Street and LA 1263 known as Jackson Road.
The Town of St. Francisville Council agrees to accept ownership of whatever rights the Department may own in and to the aforesaid described property if and only when the Department agrees to – and completes – the following:
      I.              CONDITION:  Patch and resurface the pavement with 2 inches of hot mix asphaltic concrete, and patch and rehabilitate the jointed concrete pavement as needed on those portions to be transferred to the Town of St. Francisville.
     II.              CONDITION:   Stripe the resurfaced pavement on that portion to be transferred to the Town of St. Francisville.
     III.              CONDITION:   Provide a roadway transfer credit of $854,511.78 for the portions of the state routes to be transferred to the Town of St. Francisville.  This will be applied towards the relief of the current URAF (Utility Relocation Assistance Funding) as per agreement No. 11460 of $328,021.12 and agreement No. 10019 of $761,284.21 totaling $1,089,305.33. 
The portion of state route LA 3057 known as Commerce Street from its North intersection with US 61 proceeding south approximately 1.04 miles to its intersection with LA 1263 known as Jackson Road.
The portion of state route LA 3057 known as Commerce Street from its east intersection with state route LA 1263 known as Ferdinand St.proceeding east approximately 0.98 miles to its intersection with state route US 61.
The Town of St. Francisville Council agrees to accept ownership of whatever rights the Department may own in and to the aforesaid described property if and only when the Department agrees to – and completes – the following:
      I.              CONDITION:  Patch and resurface the pavement with 2 inches of hot mix asphaltic concrete on those portions to be transferred to the Town of St. Francisville. Including widening of above mentioned 1.04 mile section, 2-3 feet on each side of existing paving.
     II.              CONDITION:   Stripe the resurfaced pavement on that portion to be transferred to the Town of St. Francisville.
     III.              CONDITION:   Provide a roadway transfer credit of $854,442.61 for the portions of the state routes to be transferred to the Town of St. Francisville. This will be applied towards the relief of the current URAF (Utility Relocation Assistance Fund) as per agreement No. 10019 of $761,284.21 for the remainder of the amount owed, totaling $234,793.55. The remainder will be applied toward construction of future enhancement projects in St. Francisville to be identified no later than December 31, 2013. Otherwise, the remainder will be applied to the repair or replacement of deficient bridges owned by St. Francisville.
The portion of state route LA 1263 known as Jackson Road from its intersection with state route LA 3057 known as Commerce Street proceeding northeast approximately 0.31 miles to its intersection with state route US 61.
The Town of St. Francisville Council agrees to accept ownership of whatever rights the Department may own in and to the aforesaid described property if and only when the Department agrees to – and completes – the following:
      I.              CONDITION:  Patch and resurface the pavement with 2 inches of hot mix asphaltic concrete on those portions to be transferred to the Town of St. Francisville.
     II.              CONDITION:   Stripe the resurfaced pavement on that portion to be transferred to the Town of St. Francisville.
     III.              CONDITION:   Provide a roadway transfer credit of $137,583.43 for the portion of the state route to be transferred to the Town of St. Francisville be applied toward construction of future roadway projects in St. Francisville to be identified no later than December 31, 2013. Otherwise, the remainder will be applied to the repair or replacement of deficient bridges owned by St. Francisville.
            RESOLVED, That the Town of St. Francisville Council shall accept ownership of whatever rights the Department may own in and to the aforesaid described property as a binding agreement between the State of Louisiana and the Town of St. Francisville, provided the State of Louisiana, Department of Transportation and Development complies with the conditions stated herein.
 
FURTHER RESOLVED, That the Town of St. Francisville Council authorizes the presiding Mayor to execute the documents necessary to transfer the aforesaid described property once the conditions of this agreement are met.
On motion by Robert R. Leake and seconded by Oscar Robertson, Jr., the above and foregoing resolution was declared duly adopted on this the 26th day of February 2013.

DOTD Resolution 2013-3 will give the Town a credit of $757,232.48 to be used for roadway repairs.
 
James Davis made a motion, Abby T. Cochran, seconded, to lease a new truck for use by Butch Mooney for a total cost of $38,325.00 from Ford Motor Credit. All in favor. Motion passed.
 
 
Mayor’s Report:
Curbs are being painted and flower beds redone in preparation for the Pilgrimage.
 
The Mayor is working with Gordon King to move our Fire truck loan from USDA to a local bank to reduce our interest rate. More details should be available for the next meeting on March 12, 2013.
 
A Biometric time clock is being purchased that will record the employee’s hand print to log on.
 
Sewer pump repairs are being made to Lift Stations 4 and 5.
 
Motion by Oscar Robertson Jr., seconded by James R. Leake to accept the $75,287 insurance proposal from Arthur J. Gallagher Risk Management Services for the 2013-2014 year.  All in favor, motion carried.
 
Resolution 2013-2, a Corporate Authorization Resolution to open a Town credit card account with a $5000.00 credit limit was presented to the board. James R. Leake made a motion to accept Resolution 2013-2, Abby T. Cochran, seconded, motion carried with a unanimous vote.
 
Police Report:
Chief Scott Ford expanded on the blighted property problems. He assured the Board that he was following through on this issue.
 
Main Street Report:
1)     Cecil Graves Autoplex (new Jeep/Dodge dealership)
Architectural Design Review Board met along with Butch Mooney to go over proposed plans.
Plans were approved with two revisions, the 50ft extension to the existing building will be facaded on the front to hide the metal and the addition of the landscape section to beginning of parking area.
2)     Businesses in town limits were sent a reminder letter about yard and banner signage and asked to remove if violating time allocation.
3)     Bonnie and Clyde Location Scouting- did final scout for 12 locations in town limits and about 10 locations in the parish.  Expected film dates will be March 25 until April 15, 2013.  Will get with Scott and Mayor to finalize town property, road closures and security.
4)     Steamboats back in town for 2013 series.
 
Motion by James Davis seconded by James R. Leake, to adjourn the meeting at 6:27 p.m. Motion carried.
