ORDINANCE NUMBER 2016 - 2

AN ORDINANCE ENACTING SUB-SECTION 16-6.1, “ORDINANCE REVOKING THE DEDICATION OF ABANDONED PUBLIC PROPERTY ADJACENT TO DIPPEL DRIVE AND ADJACENT TO LOTS 10 AND 11 OF DIPPEL SUBDIVISION,” OF SECTION 16-6, “REVOCATION OF THE DEDICATION FOR PUBLIC USE OF ABANDONED STREETS, SIDEWALKS, AND ADJACENT PROPERTY,” OF CHAPTER 16, “STREETS AND SIDEWALKS,” OF ARTICLE I, “IN GENERAL,” OF THE CODE OF ORDINANCES OF THE TOWN OF ST. FRANCISVILLE, STATE OF LOUISIANA.

Sub-Section 16-6.l, “Ordinance Revoking the Dedication of Abandoned Public Property Adjacent to Dippel Drive and Adjacent to Lots 10 and 11 of Dippel Subdivision,” of Section 16-1, “Revocation of the Dedication for Public Use of Abandoned Streets and Adjacent Property,” of Chapter 16, “Streets and Sidewalks,” of Article I, “In General,” of the Code or Ordinances of the Town of St. Francisville, State of Louisiana was offered by James R. Leake, and seconded by Abby T. Cochran. Said ordinance hereby is enacted to read as follows:


“Section 16-6. Revocation of the Dedication for Public Use of Abandoned Streets, Sidewalks, and Adjacent Property.

16-6.1. Ordinance Revoking the Dedication of Abandoned Public Property Adjacent to Dippel Drive and Adjacent to Lots 10 and 11 of Dippel Subdivision.


             BE IT ORDAINED by the Mayor and Board of Aldermen of the Town of St. Francisville, State of Louisiana, in regular session this day, lawfully convened:

     The below described property within Dippel Subdivision, an arc appurtenant to Dippel Drive and dedicated for public use, in truth and in fact having been abandoned and no longer needed for public use; said property be and hereby is declared abandoned and the dedication thereof for public use be and the same hereby is vacated, revoked, and set aside in favor of the owners of Lots 10 and 11 of Dippel Subdivision, as their interests appear according to law:

That property shown on a map or plat of survey dated as revised 9-12-1953, by James H. Kilbourne, Registered Land Surveyor, said map entitled “Dippel Subdivision, Gordon W. Dippel, Tract P445.” Said map was attached to and made a part of an Act of Cash Sale filed for record on 9-20-1957, recorded on 9-24-1957 as Original Document Number 1369 in book 51 at Page 367. The property described herein is shown on said map or plat of survey as an arc, bounded on the South by Dippel Drive, on the West and North by Lot 10, and on the North and East by Lot 11. The property abandoned herein is the entirety of that property within the arc and north of the right-of-way for Dippel Drive, all as shown on said map The new extension of the boundary between the two lots and within the abandoned property is aligned with the same coordinates as the boundary between the two original lots, as shown on the aforesaid map of survey.


     The above described arc appurtenant to Dippel Drive never has been maintained by the Town of St. Francisville nor used by the public.

     It is not the intention of this ordinance to abandon any portion of Dippel Drive.

     NOW THEREFORE BE IT ORDAINED that this ordinance shall be put into effect immediately and all ordinances or parts of ordinances in conflict herewith be and the same hereby are repealed but only in so far as the conflicts exist.”
